Your interactions with third parties are solely between you and those third parties.
9) Disclaimers THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Street Cop Training does not warrant that:
- The Services will be constantly available, or available at all; or
- The information on the Services is complete, true, accurate, or non-misleading.
Nothing on the Services constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any legal, financial, or medical matter, you should consult an appropriate professional.
YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. WE DO NOT REPRESENT OR WARRANT THAT THE SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. WHILE WE ATTEMPT TO MAKE YOUR ACCESS TO AND USE OF THE SERVICES SAFE, WE CANNOT AND DO NOT REPRESENT OR WARRANT THAT THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10) Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STREET COP TRAINING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY—WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, WARRANTY, STRICT LIABILITY, OR OTHERWISE—FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES, OR FOR ANY BUSINESS LOSSES, LOSS OF REVENUE, INCOME, PROFITS, OR ANTICIPATED SAVINGS, LOSS OF CONTRACTS OR BUSINESS RELATIONSHIPS, LOSS OF REPUTATION OR GOODWILL, OR LOSS OR CORRUPTION OF INFORMATION OR DATA, EVEN IF STREET COP TRAINING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE TOTAL LIABILITY OF STREET COP TRAINING FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
These limitations of liability apply even if Street Cop Training has been expressly advised of the potential loss.
Nothing in these Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit, or Street Cop Training’s liability in respect of death or personal injury caused by Street Cop Training’s negligence, or any matter which it would be illegal or unlawful for Street Cop Training to exclude or limit.
By using the Services, you agree that the exclusions and limitations of liability set out in these Terms are reasonable. If you do not think they are reasonable, you must not use the Services.
11) Indemnification To the fullest extent permitted by applicable law, you will indemnify, defend, and hold harmless Street Cop Training and its officers, directors, employees, agents, and affiliates from and against any loss, liability, claim, demand, damages, expenses, or costs arising out of or related to (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation, misappropriation, or infringement of any rights of another; or (d) your conduct in connection with the Services.
12) Governing Law and Venue These Terms and your access to and use of the Services will be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved exclusively in the state or federal courts located in Florida.
13) Changes to these Terms We may make changes to these Terms from time to time. If we make changes, we will post the amended Terms and update the “Last Updated” date above. Unless we say otherwise, the amended Terms will be effective immediately, and your continued access to or use of the Services after we post the changes will confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop accessing and using the Services.
14) Termination We reserve the right, without notice and in our sole discretion, to terminate or suspend your right to access or use the Services. We are not responsible for any loss or harm related to your inability to access or use the Services.
15) Severability If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.
16) Entire Agreement These Terms constitute the entire agreement between you and Street Cop Training relating to your access to and use of the Services and supersede all prior or contemporaneous understandings regarding such subject matter. The failure of Street Cop Training to enforce any right or provision of these Terms will not operate as a waiver of such right or provision. These Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity. You may not assign or transfer these Terms without our prior written consent.
